Terms of Service

DoneganOS is operated by Magnetic Holdings LLC ("we", "us"). These terms are an agreement between you and Magnetic Holdings LLC and govern use of the DoneganOS marketing website (doneganos.com), web app (donegan.app) and mobile apps (the "Service"). By creating an account or using the Service you agree to them. If you use the Service for a company, you confirm you are authorized to accept these terms for that company.

1. Accounts

  • Keep your sign-in details secure and tell us about any unauthorized use.
  • Company owners control who joins their company and which role each person has.
  • Customer portal accounts are created by invitation from the Business that serves you.

2. Your data

Each Business owns the records it enters into DoneganOS. You give us permission to host, process and display that content only to provide and support the Service. You are responsible for having the right to enter the information you add, including customer contact details and photos, and for sending communications to your customers lawfully.

3. Subscriptions, trials and billing

  • New companies may receive a free trial. Card processing for your own customers is available on a paid plan.
  • Paid plans are billed through Stripe at the price shown when you subscribe.
  • If a payment fails, your company enters a grace period and may then become read-only. Your data is not deleted because of a billing problem, and you can reactivate at any time.

4. Payments to your business

Payments your customers make to you are processed by Stripe under Stripe's own terms. You are responsible for your prices, taxes, refunds and disputes with your customers.

5. Acceptable use

Do not misuse the Service, including by:

  • accessing another company's data or attempting to bypass security;
  • sending spam or unlawful messages;
  • uploading unlawful content or content you have no right to use;
  • interfering with or reverse-engineering the Service.

6. AI features

AI-assisted features produce suggestions and proposals that may be inaccurate. Proposed changes are not applied until a user approves them. Review results before relying on them.

7. Availability and changes

We work to keep the Service available but do not promise it will be uninterrupted or error-free. We may change features over time.

8. Ending use

You may stop using the Service and request account deletion at any time (see Delete your account). We may suspend accounts that violate these terms.

9. Disclaimers and liability

The Service is provided "as is" to the extent permitted by law. To the extent permitted by law, DoneganOS is not liable for indirect or consequential losses, and its total liability is limited to the amount you paid for the Service in the twelve months before the claim. 10. Governing law

These terms are governed by the laws of the State of Georgia, United States, without regard to its conflict-of-law rules. Any dispute arising from these terms or the Service will be brought exclusively in the state courts located in Bartow County, Georgia, or the United States federal court with jurisdiction over Bartow County, Georgia, and you and we consent to the jurisdiction of those courts.
